Terms of Service

These Terms govern your use of yourtrend.ing, its business portal, and related Trend catalog services (the “Services”). “Trend,” “we,” and “us” mean TREND LLC, a limited liability company operating in Florida, United States, which operates these Services under the Trend name. Contact us at daniel@yourtrend.ing. Our Privacy Policy explains how we handle personal information.

1. Agreement and eligibility

By expressly accepting these Terms when creating or signing in to an account, you agree to them. You must be at least 18 and legally able to enter a contract to create an account. If you act for a business, you represent that you have authority to bind that business; “you” includes that business. If you lack that authority, do not create or use its workspace. Merely visiting a public page does not waive your statutory rights.

2. What Trend provides

Trend provides product discovery and tools for businesses to submit, review, and publish product catalogs. Features may be limited, experimental, or unavailable. We do not promise a minimum audience, sales, revenue, ranking, uptime, compatibility, or availability of any integration.

Unless a separate checkout expressly states otherwise, Trend is not the seller, manufacturer, payment processor, or party to a purchase from a listed business. That business is responsible for its products, pricing, inventory, taxes, shipping, returns, warranties, and customer service. Its own purchase terms apply. A listing, verification label, or recommendation is not an endorsement or guarantee of a product or merchant.

3. Accounts and authorized access

Provide accurate account and business information, protect your login credentials, and promptly report suspected misuse. Do not share personal login credentials. Owners must give team members appropriate permissions and remove access when it is no longer needed. You are responsible for actions you authorize through your workspace, subject to applicable law. We may request reasonable evidence of business ownership, investigate abuse, and restrict access while a review is pending.

4. Your catalog and content

You retain ownership of the material you submit. You represent that you own or have the necessary rights to provide your product information, images, trademarks, descriptions, and other content; that it is accurate and lawful; and that its use as described here does not infringe another person’s rights. You must maintain current prices, availability, product claims, and links and correct or remove inaccurate listings promptly.

You grant Trend a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, transmit, and display submitted content as needed to operate, secure, and improve the Services and to display your published listings to shoppers. We may permit service providers to exercise these rights only to provide services for Trend. This license does not transfer ownership or authorize unrelated sale of your private uploads. Publication is subject to your selections, our review, and these Terms.

When you unpublish content, we stop displaying it through our active catalog, subject to reasonable processing and caching delays. Limited copies may remain in backups, security logs, legal records, and transactions already initiated, as described in the Privacy Policy. You must not upload customer lists, payment credentials, sensitive personal information, or other data that is not needed for a product catalog.

5. Integrations and third-party services

You authorize only the access you approve when connecting a store or service. You must have permission to grant that access and comply with the provider’s terms. Shopify and other providers control their own availability, permissions, and policies. We may suspend an integration when authorization expires or its operation would create a security or legal risk. Disconnecting a source may not automatically remove previously imported content; review and unpublish your listings separately.

6. Prohibited use

• No fraud, impersonation, counterfeit goods, infringement, deceptive product claims, or unlawful content or sales.
• No unauthorized access, attempts to bypass permissions or limits, malware, or interference with another user’s data or service.
• No harvesting personal information, using another business’s credentials, or submitting content you are not authorized to provide.
• No automated extraction that bypasses access controls, imposes an unreasonable load, or violates applicable law; no resale of access without our written permission.

We may review, refuse, remove, or limit content to enforce these Terms, protect users, respond to rights complaints, or comply with law. We are not obliged to monitor every listing or resolve disputes between users.

7. Trend’s intellectual property

The Services’ software, design, branding, and original materials belong to Trend or its licensors. Subject to these Terms, you may use the Services for their intended purpose. No other rights are granted. You may not copy our branding or represent that we sponsor your business without permission. You may send voluntary feedback; we may use it without compensation, but feedback does not include your private catalog data.

8. Fees and changes

These Terms do not authorize an undisclosed charge. Any paid plan, fee, renewal, or billing arrangement must be presented separately and accepted before it applies. We may change or discontinue features. We will provide reasonable notice of material changes where practicable and required by law. Material changes to these Terms will be identified by an updated version and communicated through the Services or email; when required, we will request renewed acceptance. Changes do not retroactively remove accrued rights or apply to an already-arisen dispute.

9. Suspension and termination

You may stop using the Services and request account closure at daniel@yourtrend.ing. We may suspend or terminate access for a material breach, security threat, unlawful activity, failure to maintain required authorization, or discontinuation of the Services. Where appropriate, we will provide notice and an opportunity to resolve the issue; urgent action may be taken without advance notice. You should keep your own copies of submitted catalogs. Data handling following closure is described in the Privacy Policy. Provisions that reasonably need to survive termination, including accrued obligations, intellectual-property rights, liability limits, and dispute terms, survive.

10. Disclaimers

To the extent permitted by law, the Services are provided “as is” and “as available.” Trend disclaims implied warranties of merchantability, fitness for a particular purpose, and noninfringement, and does not warrant that the Services or third-party content will be uninterrupted, error-free, accurate, or free of harmful components. Catalog information and recommendations may be incomplete or outdated. Verify material product and transaction details with the relevant seller. These disclaimers do not exclude warranties or rights that cannot lawfully be excluded.

11. Limits on liability

To the maximum extent permitted by law, Trend and its personnel and service providers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, business opportunities, goodwill, or data arising from the Services or these Terms, even if advised of the possibility. Subject to the exceptions below, their aggregate liability for claims arising from the Services or these Terms will not exceed the greater of US $100 or the fees you paid Trend for the Services during the 12 months before the event giving rise to the claim.

These limits do not apply to fraud, willful misconduct, gross negligence, death or personal injury caused by negligence where applicable law prohibits limitation, or any other liability that cannot legally be limited. Mandatory consumer protections remain available. Some jurisdictions do not permit all of these exclusions or limits; in those jurisdictions they apply only to the extent permitted.

12. Business indemnity

If you use the Services for a business, you agree, to the extent permitted by law, to defend and indemnify Trend and its personnel against third-party claims and reasonable costs, including reasonable legal fees, arising from your submitted content, your products or transactions, your infringement of another party’s rights, or your material breach of these Terms. This does not cover claims to the extent caused by Trend’s own unlawful conduct, negligence, or breach. We will promptly notify you of a claim, provide reasonable cooperation at your expense, and let you control its defense with competent counsel. You may not agree to a settlement that admits fault by Trend or imposes nonmonetary obligations on it without its consent, not to be unreasonably withheld.

13. Complaints and disputes

Contact daniel@yourtrend.ing with a description of a problem so we can try to resolve it. This does not prevent either party from seeking urgent relief or exercising legal rights, and does not shorten a statutory filing period. These Terms and disputes arising from them or the Services are governed by Florida law, without regard to conflict-of-law rules, and applicable federal law. To the extent permitted by law, the parties agree to the exclusive jurisdiction of state and federal courts located in Florida that have subject-matter jurisdiction over the dispute. If you are a consumer, this provision does not deprive you of mandatory protections or the right to bring proceedings in a court available to you under applicable law. These Terms do not impose mandatory arbitration or a class-action waiver.

For an intellectual-property complaint, identify the material and its location, explain your rights and concern, and provide contact information. We may request supporting information and remove or restrict disputed content where appropriate.

14. General provisions

These Terms and any applicable separately accepted written agreement form the agreement concerning the Services. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver. You may not transfer your account or agreement without our consent; Trend may transfer it in connection with a merger, reorganization, or sale of the relevant business, subject to applicable law and the Privacy Policy. Neither party is responsible for delays beyond its reasonable control, except payment obligations already due or duties that law does not excuse. No partnership, employment, agency, or fiduciary relationship is created.
